O Rogério que me corrija que eu de leis não percebo muito, mas de acordo com a Wikipedia um Amicus Curiae (amigo da corte) «refers to someone, not a party to a case, who volunteers to offer information on a point of law or some other aspect of the case to assist the court in deciding a matter before it. The information may be a legal opinion in the form of a brief, testimony that has not been solicited by any of the parties, or a learned treatise on a matter that bears on the case. The decision whether to admit the information lies with the discretion of the court». Ou seja, diria que se refere a um estranho a um determinado caso que resolve de motu proprio fornecer informação não solicitada com o intuito de iluminar quem de direito o irá decidir.
Assim sendo, fiquei espantada com este Amicus Curiae em nome de Deus destinado a «auxiliar» o Supremo Tribunal californiano a decidir os muitos casos contra a neste momento suspensa Prop 8. O esclarecimento ao Supremo não se fica pela «explicação» de que é crime o casamento de pessoas do mesmo sexo, alarga-se a um monte de outras blasfémias, como sejam o aborto ou a investigação em células estaminais.
Devo esclarecer que não fiquei espantada por alguém usar argumentos de falsa autoridade divina para promover a intolerância e a discriminação do «outro», infelizmente bastante comuns, mas sim com os termos em que essa suposta autoridade foi estabelecida, termos esses que me parecem ser mais do domínio de especialidade da Ana que do Rogério (aliás, todas as 14 páginas do texto me parecem desse domínio).
